These terms and conditions apply to all transactions on this site. Please read them carefully. They do not affect your statutory rights.
This site is owned and operated by Hendy Performance (“Hendy Performance”, “we” or “us” or “our”). These terms and conditions apply to the use of this website and by accessing this website and/or placing an order you agree to be bound by the terms and conditions set out here. If you do not agree to be bound by these terms and conditions you may not use or access this website.

The contract between us
Any contract for purchases made through the website will be with Hendy Performance . Hendy Performance must receive payment of the whole of the price for the goods that you order before your order can be accepted, and the contract formed. Payment is not taken until the point of dispatch of the goods to you from our distribution centre.
Once payment has been received Hendy Performance will confirm that your order has been received by sending an email to you at the email address you provide in your registration form. The shipment email will include your name, the order number and the total price. Hendy Performance acceptance of your order brings into existence a legally binding contract between us on these terms. Any term sought to be imposed by you in your order will not form part of the contract.
Hendy Performance is entitled to withdraw from any contract in the case of obvious errors or inaccuracies regarding the goods appearing on our website. If an error or inaccuracy is discovered with regards to the advertised price of the goods that you have ordered, we will contact you as soon as possible by e-mail. This will be to inform you of the correct price of the goods, and to ask you if you wish to continue with the order at the amended price, or to cancel the order altogether.

Import duties, taxes, and charges are not included in the item price or shipping cost. These charges are the buyer's responsibility. Please check with your country's customs office to determine what these additional costs will be prior buying.
These terms and conditions and all transactions relating to this website are governed by English law and are subject to the non–exclusive jurisdiction of the English courts. We do not accept amendments to these terms and conditions.
Additional terms and conditions may apply for prize competitions, online bidding, pre–release orders and our added value services and offers. If so, you will be alerted to them at the relevant juncture.
These terms and conditions only cover the Hendy Performance website. Any other websites which are linked to from this site are governed by their own terms and conditions. We accept no responsibility or liability for the content or operation of websites, which are not under our control. We are required by law to tell you that sales can be concluded in English only and that no public filing requirements apply.
Hendy Performance own the copyright, trademarks and other intellectual property rights in all material and content on this website, which you may use, download, copy, publish, transmit or otherwise make available by any other means only for your own personal, non–commercial use. Any other use or reproduction of the material or content is strictly prohibited.
You may not create any link to this website without prior written consent, nor may you restrict or inhibit the use or enjoyment of it by anyone else.
While we will use reasonable endeavours to verify the accuracy of any information we place on the Hendy Performance website, we make no warranties, whether express or implied in relation to its accuracy.

We will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the Hendy Performance website.
Hendy Performance accepts payment by Visa, MasterCard, Switch, Maestro and Delta. All product prices and delivery charges are shown in UK pounds sterling. Your payment card company will perform any currency conversion.
Upon receiving your order Hendy Performance carries out a standard pre-authorisation check on your payment card to ensure there are sufficient funds in order to fulfil the transaction. No payment is debited from your card during this pre-authorisation check. Your card will only be charged upon dispatch of the items in your order.
Availability of goods you order
If Hendy Performance has insufficient stock to deliver the goods ordered by you, we will notify you as soon as possible and any sum debited by Hendy Performance from your credit card will be re-credited to your account and Hendy Performance will notify you by email at the address given by you in your order form. The refund will be made as soon as possible and in any event within 30 days of your order. Hendy Performance will not be obliged to offer any additional compensation for disappointment suffered.
Please note: we endeavour to bring our customers the best value we can by running special offers, but please remember stocks are limited at the special offer price, and subject to availability. We update our website as quickly as we can to minimise disappointment. The process of updating the website when goods have sold out at promotional price can take a few hours to update.
Changes to this agreement
Hendy Performance reserves the right to make changes to our site, policies, and these terms and conditions at any time. If any of these conditions shall be deemed invalid, void, or for any reason unforeseen, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
Terms and conditions of sale including returns
1. All products supplied which have been sourced from a manufacturer / supplier with whom we have an agency or distributor agreement with are subject to the Conditions of Sale of that respective manufacturer /supplier which may be seen on request.
2. All other products goods or services supplied are subject to the Conditions of Sale expressly stated on the Order Form, Service Job Card, or Acknowledgement of Order.
3. In the event of any query, please quote the Invoice Number.Goods supplied cannot be accepted for credit or refund unless returned within 14 days of issue and be undamaged and in the condition of original supply. We reserve the right to make a 15% handling charge on goods returned against order correctly executed. Non-stocking items on special order are not normally refundable.
4. Items supplied under an Exchange Scheme must be returned within 14 working days to the originating depot quoting the Invoice Number otherwise any surcharge or credit will not be given.
5. In the event that labour and / or parts are charged pending are port from the Manufacturer, such charges are to be paid in accordance with the Terms of Credit. Any refund due will be subsequently made in accordance with the Manufacturers decision.
6. Credit accounts are settled in accordance with the Terms of Credit, payment for goods / senses should be received no later than the 25th of the month following the invoice date.
7. The Company reserves the right to charge interest at the rate of 2% above Bank Base Rate on any overdue balance.
8. Faulty products.
Please contact us should your product become faulty, The majority of our products come with 1 years warranty, unless otherwise stated. Although there are exceptions with some suppliers we deal with that may offer longer warranties. Please contact us prior to ordering if you need clarification. Products designed to be used in off road / non road legal applications may come with no warranty.
Should your product become faulty you must notify us within 30 days to arrange a refund, replacement or repair.
9. Change of mind.
Should you change your mind on the order, we offer a 30 working day returns and refund policy from the date of delivery in accordance to the UK distance selling regulations SR. You will receive the full refund to the value of the order (delivery costs not included). The parcel must be returned in brand new condition, unopened and in the original packaging. The customer must cover the delivery cost of the return of the product/order.
